Terms of Service

Welcome to LumiCV. These Terms of Service ("Terms") govern your access to and use of the LumiCV website, web application, and browser extension (collectively, the "Service") operated by Octany Labs, a company based in the Netherlands and registered with the Dutch Chamber of Commerce (KVK) under number 42069241 ("Octany Labs", "we", "our", or "us"). LumiCV is a product of Octany Labs. Please read them carefully.

These Terms are provided in English. Translations may be provided for convenience; in case of conflict, the English version prevails.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

3. The Service

LumiCV provides an AI-powered career platform that includes resume building, job application tracking, AI resume tailoring, cover letter generation, interview preparation tools, a browser extension for extracting job descriptions and autofilling applications, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

We do not guarantee that the Service will be available 100% of the time. Planned maintenance and unforeseen outages may temporarily affect availability.

5. AI-Generated Content

LumiCV uses AI to generate resume content, cover letters, interview questions, and other career-related text. You acknowledge that:

By using AI features, you grant LumiCV a limited, non-exclusive license to process your input data (resume content, job descriptions) through our AI providers solely to generate outputs for you. We do not use your data to train AI models.

6. Payments & Subscriptions

Free Plan

LumiCV offers a free plan with limited features. No payment is required for the free plan. Free-plan limits at the time of publication are: up to 2 saved resumes, up to 50 tracked jobs, and 5 AI credits per calendar month. Limits may change; current limits are always shown in the app and on the Pricing page.

Pro Subscription

Pro plans are billed in advance on a recurring basis via Stripe. Available billing intervals (currently monthly, every 3 months, every 6 months, and annual) and prices are shown on the Pricing page. By subscribing, you authorize us to charge your payment method on each renewal date. Prices are displayed in EUR by default and in USD for visitors from the United States, Canada, the United Kingdom, Australia, and New Zealand (you can switch the displayed currency on the pricing page). You are billed in the currency shown at checkout, which is then locked to your subscription for its lifetime. Prices shown are the final price; no VAT is added at checkout.

Cancellation

You may cancel your subscription at any time from the Billing section of your account. Cancellation takes effect at the end of your current billing period. You retain access to Pro features until the period ends, after which your account reverts to the free plan. We do not offer prorated refunds for partial billing periods.

Free Trial

We offer a 7-day free trial on new Pro plan subscriptions. A valid payment method is required at checkout to start the trial. You will not be charged during the trial period, and you can cancel any time before the trial ends to avoid being charged. If you do not cancel before the trial ends, your chosen plan is billed automatically at the price shown at checkout.

EU Right of Withdrawal (14 days)

If you are a consumer in the European Union, you have a statutory right to withdraw from a distance contract for digital services within 14 days of entering into it, without giving a reason (Art. 6:230o Dutch Civil Code, implementing Directive 2011/83/EU).

Because the Service is a digital service delivered immediately, by starting to use the paid Service (for example, consuming AI credits on a paid plan) you expressly request immediate performance and acknowledge that you lose your right of withdrawal once performance has begun with your consent. During the 7-day free trial, no payment is taken, so the withdrawal right is in practice covered by your ability to cancel the trial at any time.

To exercise the withdrawal right where it still applies, email [email protected] within 14 days of subscribing with a clear statement that you wish to withdraw.

Refunds

30-day money-back guarantee. Your first paid Pro charge after the free trial is covered by our voluntary 30-day money-back guarantee: email [email protected] within 30 days of that charge and we will refund it in full. The guarantee applies once per customer and does not cover renewal charges. Its full conditions, including fair use and exceptions, are set out in our Refund Policy, which applies alongside these Terms. The guarantee is in addition to, not in place of, your statutory rights.

Outside the 30-day guarantee, the free trial and the withdrawal right above, subscription payments are non-refundable except where required by applicable law. We do not offer prorated refunds for partial billing periods. If you believe a charge was made in error, contact us at [email protected] within 14 days of the charge.

Price Changes

We may change our pricing with at least 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

7. Intellectual Property

Your Content

You retain ownership of all content you upload to LumiCV, including your resume data, job information, and any documents you create ("Your Content"). You grant LumiCV a limited, non-exclusive, worldwide, royalty-free license to store, process, and display Your Content solely to provide the Service to you.

Our Platform

The LumiCV platform, including its design, codebase, trademarks, logos, and proprietary features, is owned by LumiCV and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works from any part of our platform without our written permission.

8. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access to the Service immediately, without notice, if you violate these Terms or if we are required to do so by law.

Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LUMICV DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE EMPLOYMENT OUTCOMES OR INTERVIEW SUCCESS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMICV AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50.

Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) gross negligence or intentional misconduct; or (iv) any other liability that cannot be excluded or limited under applicable mandatory law, including statutory rights of consumers under Dutch and EU law.

11. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands, excluding its rules on conflict of laws and the UN Convention on Contracts for the International Sale of Goods. Any dispute arising out of or in connection with these Terms or your use of the Service shall be submitted to the competent courts of Amsterdam, the Netherlands.

If you are a consumer resident in the European Union, nothing in this section deprives you of the protection of mandatory consumer-law provisions of your country of residence, including your right to bring proceedings in the courts of your country of residence.

The European Commission provides an online dispute resolution platform for consumers at ec.europa.eu/consumers/odr. We are, however, not obliged and not willing to participate in a dispute settlement procedure before a consumer arbitration board.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

13. Browser Extension

LumiCV offers an optional browser extension that enhances the Service by extracting job description data from supported job boards and autofilling application forms. By installing and using the extension, you agree to the following additional terms:

Supported Platforms

The extension operates on the following job boards and applicant tracking systems: LinkedIn, Indeed, Glassdoor, Greenhouse, Lever, Workday, and SmartRecruiters. We may add or remove supported platforms at any time.

Data Extraction

The extension extracts publicly visible job description data (job title, company name, location, and description text) from pages you visit on supported platforms. On LinkedIn, the extension may also read your public profile data if you use the LinkedIn Profile Optimizer feature. The extension does not access private messages, connection lists, or data not visible on the page you are viewing.

Third-Party Terms of Service

You are responsible for complying with the terms of service of any third-party platform on which you use the extension. LumiCV does not guarantee that the extension's functionality is authorized by or compliant with any third-party platform's terms. You use the extension on third-party platforms at your own risk.

Autofill

The extension may autofill job application forms using data from your LumiCV profile (name, email, phone number, location). You are responsible for reviewing and verifying all autofilled data before submitting any application.

Permissions

The extension requires certain browser permissions to function, including access to specific website domains, browser storage, and active tab information. These permissions are used solely to provide the described functionality. A full list of permissions is available on the extension's store listing.

Removal

You may uninstall the extension at any time through your browser's extension management settings. Uninstalling the extension removes all locally stored data (authentication tokens, cached preferences). Data previously sent to LumiCV (saved jobs, generated resumes) remains in your account and can be deleted through your account settings or by deleting your account.
